GENERAL TERMS AND CONDITIONS FOR ONLINE SALES
SCOPE OF APPLICATION
The present general conditions of sale apply unconditionally to all sales made online at the website www.moco.art, to the exclusion of any other sales (including counter sales at the Hôtel des Collections and those through agencies or partners, etc.). The following terms and conditions of sale take precedence over all other provisions to the contrary.
ORDERING – TICKETS
Only individual tickets are available for sale.
Patrons wishing to benefit from group rates should obtain their tickets on site or by contacting visitor services directly with a reservation request to: reservation@moco.art
Tickets purchased online are limited to a maximum of 19 per order.
Tickets sold online are valid for a specific day of admission selected by the customer (depending on availability).
Validation by the customer of their order entails acceptance of these general terms and conditions of sale.
As long as payment has not been completed, the contents of the order may be modified by clicking on the “My Cart” icon.
Orders are final only once payment has been made.
It is the customer’s responsibility to print out the purchased tickets, at the latest on the day of the visit.
Tickets can be neither returned, nor changed, nor exchanged, except in the event of cancellation by EPCC MO.CO Montpellier Contemporain of the event for which they are issued.
Tickets are valid solely on the day shown.
Patrons must keep their ticket with them during their visit so as to present it to a staff member at their request at any time. A ticket permits one single readmission on the day shown.
Orders are archived and payment documents conserved on a reliable, fixed media constituting a “truthful and durable copy” in accordance with Article 1348 of the French Civil Code.
RATES
The applicable rates are those in effect on the day payment is confirmed.
The EPCC MO.CO reserves the right to modify these rates at any time subsequent to deliberation by the Board.
ONLINE PAYMENTS
Payment of the ticket price is made online, through a secure payment portal and in Euros.
Debit takes place immediately the order is validated, independently of when the tickets are printed out.
The EPCC MO.CO guarantees that the cryptographic methods and services used to secure transactions have been authorized and/or declared in accordance with the legislation in force.
Following payment registration a sales confirmation email is sent to the customer.
NO COOLING-OFF PERIOD
In accordance with the provisions of paragraph 2 Article L. 121-20-4 of the French Consumer Code and paragraph 12 Article L. 121-21-8 of the same Code, online ticket sales do not benefit from a right of withdrawal.
DELIVERY TIMES
Once payment has been made a confirmation email is sent to the customer at the address provided by them together with the e-ticket(s) as an attachment within a maximum period of thirty days.
If the time between the order and the visit date chosen is less than thirty days, tickets will be sent to the customer no later than one day before that date.
It is the customer's responsibility to print out the purchased tickets, at the latest on the day of the visit.
ADMISSION TO THE HÔTEL DES COLLECTIONS SITE
On the day of the visit customers will present themselves at the ticket office with a printout of the e-ticket.
Before admission is granted to the visit(s) indicated on the ticket(s), it/they will be inspected by a member of staff at the entrance.
No duplicate tickets will be issued.
Patrons arriving at the ticket office without a ticket will be invited to join the queue for visitors without tickets and will have to pay the entrance fee shown at the ticket office to continue their visit.
Customers purchasing concessionary tickets (students, jobseekers; special family rates) must present proof of their right to the applicable discount on the day of the visit. Failing
this, they will be charged a supplement corresponding to the difference between the full and the reduced ticket price. A receipt will be issued.
CANCELLATION OF OR ALTERATIONS TO VISITS
The EPCC MO.CO reserves the right to alter and/or cancel all or part of any event or exhibition for which tickets have been purchased online. It will take reasonable steps to inform the customer, including sending an email to the address provided at the time of booking.
In this case, patrons accept that our customer service department uses the contact details entered by him/her at the time of booking to inform him/her of the course of action required.
RESPONSIBILITIES OF THE EPCC MO.CO
The EPCC MO.CO is responsible for the delivery of tickets under the conditions defined in these terms of sale and for properly fulfilling the obligations outlined in the contract, whether these obligations are effected by the institution itself or by other service providers, without prejudice to its right of recourse against the latter.
The EPCC MO.CO, however, cannot be held liable in the event of the non-fulfillment of its obligations being attributable to the customer, or to the actions of a third party to the sale concluded with the customer, or to a case of force majeure.
The EPCC MO.CO, owner of the site, undertakes to comply exclusively with laws and regulations in force in France.
RESPONSIBILITIES OF THE CUSTOMER
The customer is expected check the ticket(s) and online purchase confirmation delivered to and received in his/her email inbox.
Patrons are solely responsible for the use they, their relatives or friends, or any third parties make of the tickets purchased by them.
During their visit visitors must respect the security regulations on display at the Hôtel des Collections counter.
Minors visit the site under the supervision of their parent(s) or guardian(s) who are responsible for them.
The EPCC MO.CO reserves the right to revoke or refuse admission at any time to customers or to any participants in the visit engaging in conduct thought to be liable to harm, endanger, or disturb any of its employees, subcontractors, or agents, or other patrons.
In this case, the customer shall not be entitled to any refund or compensation for the early termination of his/her visit.
DATA PROTECTION
Information and data relating to customers and disclosed by them when purchasing tickets online are subject to a system of automated processing registered with the CNIL (the French data protection commission). Such information and data is stored in a unique personal account.
As necessary, they may be used by our customer service department to facilitate future bookings on the website.
In accordance with the amended French Data Protection Act of 6 January, 1978, customers possess the right to access, rectify, and/or delete their personal data.
For any related request customers should get in touch with the EPCC MO.CO at the contact details provided below by registered mail, indicating their full name, address, and, if possible, customer reference number. The letter must be signed and accompanied by a copy of ID bearing the customer’s signature.
Customer information and personal data will only be used for direct marketing purposes by the EPCC MO.CO and/or its partners, with their consent. Customers may choose to subscribe or unsubscribe to such offers at any time in “My Account.”
EMENDATIONS TO THE GENERAL TERMS AND CONDITIONS OF SALE
These general terms and conditions of sale are subject to change.
The general conditions applying to sales are those in force at the time of payment confirmation by the company.
SEPARATE CLAUSES
In the event of one or more of the clauses of these general terms and conditions of sale being or becoming null and void, this shall not affect the validity of the other clauses of these general terms and conditions of sale, which are deemed separable.

APPLICABLE LAW AND DISPUTE RESOLUTION
These general terms and conditions of sale, including any order(s) placed by the customer, are governed exclusively by French law and fall under the jurisdiction of the French courts.
In the event of a dispute resulting from the drawing up, interpretation, or fulfillment of these general terms and conditions of sale, arbitration will be sought between the parties before legal action is filed.
